
Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the MarkUDown platform ("Service"), operated by Scrape Technology ("we", "our"), including the web dashboard, the API, and its web content extraction and conversion endpoints (scrape, crawl, map, extract, search, rss, screenshot, change-detection, batch-scrape, among others). By creating an account, obtaining an API key, or using the Service in any way, you ("Customer", "User") agree to fully comply with these Terms. If you are accepting on behalf of a company, you represent that you have the authority to bind it to this agreement.
2. Service Description
MarkUDown converts web pages into clean Markdown and structured data, offering endpoints for single-page scraping, crawling, site mapping, search, change monitoring, screenshot capture, and AI-powered data extraction, available via API and billed by credits consumed per call. The Service is a data-extraction infrastructure tool: we do not select, curate, or direct the content you collect, nor do we actively monitor the content of sites accessed through your account.
3. Eligibility and Account
You must be at least 18 years old and have the legal capacity to contract. You are responsible for keeping your access credentials and API key(s) confidential, and for all activity carried out under your account. Notify us immediately in the event of unauthorized use or a credential leak.
4. Acceptable Use
You agree to use the Service only for lawful purposes and are solely responsible for the legality, suitability, and manner of any data collection you perform. You are expressly prohibited from using MarkUDown to: (a) access systems, accounts, or data without authorization, including brute-force attacks, credential stuffing, or third-party account takeover; (b) collect sensitive personal data, data of minors, or data in violation of the GDPR, Brazil's LGPD, or any applicable data protection law; (c) carry out denial-of-service (DDoS) attacks, send spam, commit fraud, or engage in any activity that overloads, damages, or harms third parties; (d) infringe the intellectual property rights, trade secrets, or contracts (including target sites' Terms of Use) of third parties; (e) collect, store, or distribute illegal content, including child exploitation material, content promoting violence, or any content prohibited by law; (f) resell, sublicense, or redistribute access to the Service without prior written authorization. Violation of this clause authorizes immediate suspension or termination of the account, without prejudice to other applicable remedies.
5. Responsibility for Data Collection
MarkUDown is a technical infrastructure tool. It is the Customer's sole responsibility to assess the legality of the intended data collection, including any restrictions imposed by robots.txt, the Terms of Use of target sites, and applicable law (civil, criminal, competition, and data protection) in the relevant jurisdiction(s). Where the Customer acts as the data controller for personal data collected through the Service, the Customer is solely responsible for complying with controller obligations under the GDPR/LGPD, including legal basis, data subject rights, and any incident notifications. Scrape Technology does not curate, verify, or validate content collected by the Customer and does not guarantee that using the Service makes data collection immune to blocking, technical restrictions, or legal consequences imposed by third parties or authorities.
6. API Keys and Security
API keys are personal and non-transferable and must not be exposed in public repositories, client-side applications, or shared with third parties. We reserve the right to revoke or rotate keys that are compromised, suspected of abuse, or associated with activity that violates these Terms, with notice when reasonably possible.
7. Plans, Billing, and Credits
The Service is billed by credits consumed, with a fixed cost per call depending on the endpoint used, per the then-current table published at /markudown, purchasable via a monthly subscription plan with a credit allowance or one-off credit packs. Unused credits do not carry over between cycles, unless stated otherwise. Usage exceeding the contracted allowance may be billed at the then-current pay-as-you-go rate. Refunds, where applicable, follow the then-current cancellation policy and applicable consumer protection law. Price changes will be communicated with reasonable advance notice and do not affect already-paid cycles.
8. Third-Party AI Processing
Certain Service endpoints (including, without limitation, /extract, /prompt-extract, and /smart-extract) use third-party artificial intelligence models (such as Google Gemini and OpenAI) to interpret and structure collected content. By using these endpoints, the Customer acknowledges and agrees that the content of the processed page may be transmitted to those third-party providers to generate the response, subject to each provider's respective data-handling policies. The Customer must not use these endpoints to process sensitive personal data without an adequate legal basis and without assessing compatibility with its own data protection obligations.
9. Service Availability and Limitations
The Service is provided "as is" and "as available", without warranty of uninterrupted or error-free operation. The ability to access specific target sites may be affected by anti-bot measures, changes to site structure, or third-party unavailability, circumstances beyond our control. AI-based endpoints depend on the availability and performance of the third-party providers referenced in Clause 8.
10. Intellectual Property
MarkUDown, including its proprietary code, brand, infrastructure, and documentation, is owned by Scrape Technology or its licensors. We grant the Customer a limited, non-exclusive, revocable license to use the API in accordance with these Terms. Data extracted through the Service belongs to the Customer, who is responsible for ensuring it holds the necessary rights over such data.
11. Privacy and Data Protection
Scrape Technology's processing of the Customer's personal data (registration, billing, platform use) complies with applicable data protection law. Additional information on data collection and processing may be detailed in a dedicated Privacy Policy, which supplements these Terms.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Scrape Technology is not liable for indirect damages, lost profits, or loss of data or business arising from use or inability to use the Service, including blocks imposed by target sites, unavailability of third-party AI providers, or legal consequences of the Customer's misuse of the Service. Scrape Technology's total liability, where applicable, is limited to the amount actually paid by the Customer in the 3 (three) months preceding the triggering event.
13. Indemnification
The Customer agrees to indemnify and hold Scrape Technology harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from use of the Service in violation of these Terms, applicable law, or third-party rights, including claims by data subjects or target sites.
14. Suspension and Termination
We may suspend or terminate access to the Service, immediately and without prior notice, in the event of a violation of these Terms, fraudulent use, non-payment, or legal requirement. The Customer may terminate its account at any time, remaining responsible for amounts owed through the termination date.
15. Changes to These Terms
We may update these Terms periodically to reflect changes to the Service, applicable law, or our practices. Material changes will be communicated by email or a notice on the platform with reasonable advance notice. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
16. Governing Law and Venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Scrape Technology's domicile are elected to settle any disputes arising from these Terms, with waiver of any other venue, however privileged, except where mandatory public-order legal provisions state otherwise.
